Regular Meeting

CALL TO ORDER

 

The Board of Trustees of the Town of Deer Trail met in regular session on Tuesday, April 11, 2006 at the Town Hall, 555 Second Avenue, Deer Trail, Colorado.  Mayor Jim Johnson called the meeting to order at 7:02 p.m. 

ROLL CALL

 Mayor Jim Johnson; Trustees Present:  Gary Lavoie, Russell Ness, Tami Stoumbaugh, Dutch Venter, Melvin Wood

APPROVAL OF AGENDA 

TRUSTEE WOOD MOVED, TRUSTEE T. STOUMBAUGH SECONDED to approve the agenda.  The motion carried.

APPROVAL OF THE MINUTES

TRUSTEE LAVOIE MOVED, TRUSTEE WOOD SECONDED to approve the March 7, 2006 regular meeting minutes and March 16, 2006 special meeting minutes.  The motion carried. 

PUBLIC COMMENTS 

No one in attendance had comments. 

REPORTS

Water & Sewer

-Readings

The Town Clerk reported water usage for the month of March, 2006 was 1,465,200 gallons.  The sewer flow meter recorded influent flow readings of 47,489 gallons per day and effluent readings of 27,827 gallons per day. 

Town Clerk's Report

The Town Clerk reported that the compliance date for the dangerous buildings had been moved to April 24 while the Town waits for title commitments on the two properties. 

Attorney Stan Kimble approved the Cost Recovery Agreement with Kunkel Construction, Inc.  The agreement will be signed and recorded with Arapahoe County. 

The Board was presented with the Loss Control Audit from the Town’s insurance company, CIRSA.

The April REAP meeting will be held Thursday, Apr. 13 at Antelope Hills with “Affordable Housing” the main topic of discussion. 

CML will host an Effective Governance workshop for elected officials. 

The Town Clerk presented the Board with an information packet including 2006 budgets. 

APPROVAL AND PAYMENT OF BILLS 

TRUSTEE LAVOIE MOVED, TRUSTEE NESS SECONDED to approve the payment of the bills.  Voting was as follows: YES: Johnson, Lavoie, Ness, T. Stoumbaugh, Venter, Wood  NO: None ABSTAIN:  None ABSENT: C. Stoumbaugh

The Mayor declared the motion carried. 

UNFINISHED BUSINESS 

Ordinance 233 – Nuisance Ordinance 

TRUSTEE LAVOIE MOVED, TRUSTEE WOOD SECONDED to table action on the nuisance ordinance to the May 2 meeting.  The motion carried. 

Mobile Home Regulations 

TRUSTEE LAVOIE MOVED, TRUSTEE WOOD SECONDED to take no action on mobile home regulations at this time, with possible reconsideration at a later date.  The motion carried. 

Dangerous Animal Ordinance 

TRUSTEE T. STOUMBAUGH MOVED, TRUSTEE LAVOIE MOVED to table discussion on the dangerous animal ordinance to the May 2 meeting.  The motion carried. 

Drainage Study

In order to complete the drainage study, planemetrics are needed, which will cost $4,300.  The State has agreed to split the cost with the Town, $2,150 each.

NEW BUSINESS 

2006 Municipal Election

-Swearing in of Elected Officials

The Town Clerk swore in Mayor Johnson and Trustees Sanger, Stoumbaugh, Venter, and Wood.  

-Selection of Mayor Pro Tem 

MAYOR JOHNSON MOVED, TRUSTEE LAVOIE SECONDED to appoint Trustee Stoumbaugh as Mayor Pro Tem.  The motion carried. 

-Department Appointments

The following trustees were appointed as department heads:  Trustee Lavoie – Water/Sewer; Trustee Wood – Streets; Trustee Stoumbaugh – Safety; Trustee Venter – Parks; Trustee Ness – Promotion and Planning; Trustee Sanger – Financial and Building. 

-Check Signers 

TRUSTEE LAVOIE MOVED, TRUSTEE WOOD SECONDED that Patti Owens, Jim Johnson, Dutch Venter, and Gary Lavoie be check signers on all bank accounts.  Voting was as follows: YES: Ness, Sanger, Stoumbaugh, Venter, Wood, Johnson, Lavoie NO: None ABSTAIN: None ABSENT: None

-Appointment of Unelected Officials 

TRUSTEE STOUMBAUGH MOVED, TRUSTEE WOOD SECONDED to reappoint Town Clerk Patti Owens, Town Attorney Stan Kimble, and Municipal Court Judge Dorothy Stone.  Voting was as follows:  YES: Sanger, Stoumbaugh, Venter, Wood, Johnson, Lavoie, Ness NO: None ABSTAIN:  None ABSENT:  None

The Mayor declared the motion carried. 

Building Permits 

TRUSTEE LAVOIE MOVED, TRUSTEE WOOD SECONDED to approve Kunkel Construction’s building permits for homes at 1134 Fourth Ave. and 1146 Ave., and Reed Metzger’s building permit for a steel building at 465 Third Ave.  Voting was as follows: YES: Stoumbaugh, Venter, Wood, Johnson, Lavoie, Ness, Sanger NO:None ABSTAIN: None ABSENT: None

The Mayor declared the motion carried. 

Town Clean-Up Day 

TRUSTEE NESS MOVED, TRUSTEE LAVOIE SECONDED to sponsor Town Clean-Up Day for Deer Trail residents on Saturday, May 6 from 8 a.m. to 12 noon with two roll-off dumpsters and the option of a third dumpster from Complete Disposal at a cost of $300 each.  Voting was as follows: YES: Venter, Wood, Johnson, Lavoie, Ness, Sanger, Stoumbaugh NO: None ABSTAIN: None ABSENT: None

The Mayor declared the motion carried. 

The Town Clerk will prepare a list of prohibited items.

Remediation Project 

TRUSTEE LAVOIE MOVED, TRUSTEE STOUMBAUGH SECONDED to allow Earth Environmental Services, Inc. to install three additional monitoring wells for the Corner Gas Remediation Project, one on Elm St., one on Date St., and one on Fifth Ave.  Voting was as follows: YES: Wood, Johnson, Lavoie, Ness, Sanger, Stoumbaugh, Venter NO: None ABSTAIN: None ABSENT: None

The Mayor declared the motion carried. 

Earth Environmental Services will also be reconnecting the discharge line through the new section of the WPA ditch during April or May, 2006.  The Board will require the discharge line to be buried at least 18” deep and will inspect the project for compliance.

Signs will be placed along the WPA ditch stating that motorized vehicles are not allowed in the ditch. 

Maintenance Man

Applications are being reviewed by Mayor Jim Johnson for the maintenance man position.  No recommendation was made.

Water/Wastewater Operator 

The Board reviewed bids from Ramey Environmental, Inc. and ECO Resources, Inc. 

TRUSTEE LAVOIE MOVED, TRUSTEE STOUMBAUGH SECONDED to contract with ECO Resources, Inc. for water/wastewater services at a price of $675/month with a month-to-month contract.  Voting was as follows: YES: Lavoie, Ness, Sanger, Stoumbaugh, Venter, Wood, Johnson NO: None ABSTAIN:            None ABSENT:None

The Mayor declared the motion carried. 

MAYOR JOHNSON MOVED, TRUSTEE LAVIOE SECONDED to hire ECO Resources for two hours a day, five days a week at a cost of $465 per week until the Town is able to hire and train a maintenance man for the day-to-day monitoring.  Voting was as follows: YES: Ness, Sanger, Stoumbaugh, Venter, Wood, Johnson, Lavoie NO: None ABSTAIN: None ABSENT: None  The Mayor declared the motion carried.

Trapshooting in Town Limits 

Discussion was held on trapshooting in Town limits at the Jockey Club Grounds.  Concern about the noise, safety, and alcohol was addressed. 

No action was taken. 

TRUSTEES' COMMENTS 

Trustee Venter stated that the flag and rope at Centennial Park need replaced.  Since it cannot be flown at night without a light, and no light is available, the issue was dropped. 

Trustee Ness would like to send a letter of support for the Town of Sedgwick that is seeking disaster funds for building damage after a spring snowstorm. 

TRUSTEE NESS MOVED, TRUSTEE STOUMBAUGH SECONDED to send a letter of support for the Town of Sedgwick.  The motion carried. 

Trustee Lavoie expressed his disappointment in the defeat of the sales tax issue at the April 4 election.
