CALL TO ORDER

The Board of Trustees of the Town of Deer Trail met in regular session on Tuesday, August 2, 2005 at the Town Hall, 555 Second Avenue, Deer Trail, Colorado. Mayor Pro Tem Tami Stoumbaugh called the meeting to order at 7:00 p.m.

ROLL CALL

Mayor Pro Tem: Tami Stoumbaugh  Trustees Present: Gary Lavoie, Russell Ness, Dutch Venter, Melvin Wood

Staff Present: Patti Owens, Town Clerk; Randy Eldringhoff, Maintenance

APPROVAL OF AGENDA

TRUSTEE LAVOIE MOVED, TRUSTEE WOOD SECONDED to shorten the agenda, addressing only items needing immediate attention, with the remaining items to be addressed at a continuation of this meeting, and adding an item to New Business: Flying of Flags at Half-Staff. The motion carried.

Mayor Pro Tem Stoumbaugh expressed the Board's sadness about the passing of Mayor Rector and the great loss to the Town of Deer Trail. The Board and audience observed a moment of silence.

TRUSTEE LAVOIE MOVED, MAYOR PRO TEM STOUMBAUGH SECONDED to take a five-minute recess. The motion carried.

The meeting resumed at 7:06 p.m.

TRUSTEE LAVOIE MOVED, TRUSTEE WOOD SECONDED to continue this meeting on Tuesday, August 9 at 7:00 p.m. The motion carried.

APPROVAL AND PAYMENT OF BILLS

TRUSTEE LAVOIE MOVED, TRUSTEE NESS SECONDED to approve the payment of the bills. Voting was as follows:  YES: Lavoie, Ness, Stoumbaugh, Venter, Wood  NO: None  ABSTAIN: None  ABSENT: None

The Mayor Pro Tem declared the motion carried.

UNFINISHED BUSINESS

Sewer Project

-Pay Request

TRUSTEE LAVOIE MOVED, TRUSTEE WOOD SECONDED to approve the wastewater project's eighth Outlay Report totaling $172,812.22. Voting was as follows:  YES: Ness, Stoumbaugh, Venter, Wood Lavoie  NO: None  ABSTAIN: None  ABSENT: None

The Mayor Pro Tem declared the motion carried.

NEW BUSINESS

Ordinance 226 - Creating Sewer Enterprise

TRUSTEE LAVOIE MOVED, TRUSTEE NESS SECONDED to approve Ordinance 226 establishing the Town of Deer Trail Sanitary Sewer Enterprise under the provisions of Title 37, Article 45.1, Colorado Revised Statutes, repealing all ordinances or other acts in conflict herewith, and declaring an emergency. Voting was as follows:  YES: Stoumbaugh, Venter, Wood, Lavoie, Ness  NO: None  ABSTAIN: None  ABSENT: None

The Mayor Pro Tem declared the motion carried.

Resolution 2005-01S - Authorizing Issuance of Revenue Bonds

TRUSTEE WOOD MOVED, TRUSTEE LAVOIE SECONDED to approve Resolution 2005-01S of the Town of Deer Trail Sanitary Sewer Enterprise authorizing the issuance of the Town's sanitary sewer revenue bonds in the aggregate principal amount of $717,000, providing for the use of the bond proceeds to pay the costs of providing for the payment of the bonds from the net revenue derived from the operation of the Town's sanitary sewer system, and making certain covenants in connection therewith, providing for the form, payment, and other details in connection with the bonds, and authorizing the execution of certain agreements and documents in connection with the bonds. Voting was as follows:  YES: Venter, Wood, Lavoie, Ness, Stoumbaugh  NO: None  ABSTAIN: None  ABSENT: None

The Mayor Pro Tem declared the motion carried.

Ordinance 227 - Authorizing Issuance of Revenue Bonds

TRUSTEE NESS MOVED, TRUSTEE WOOD SECONDED to approve Ordinance 227, an emergency ordinance of the Town of Deer Trail authorizing the issuance of the Town's sanitary sewer revenue bonds in the aggregate principal amount of $717,000, providing for the use of the bond proceeds to pay the costs of providing for the payment of the bonds from the net revenue derived from the operation of the Town's sanitary sewer system, making certain covenants in connection therewith, approving Resolution No. 2005-01S of the Town of Deer Trail Sanitary Sewer Enterprise providing for the form, payment, and other details in connection with the bonds, authorizing the execution of certain agreements and documents in connection with the bonds, and declaring an emergency. Voting was as follows:  YES: Wood, Lavoie, Ness, Stoumbaugh, Venter  NO: None  ABSTAIN: None  ABSENT: None

The Mayor Pro Tem declared the motion carried.

Signature Cards

MAYOR PRO TEM STOUMBAUGH MOVED, TRUSTEE WOOD SECONDED that Trustee Venter, Trustee Lavoie, and Town Clerk, Patti Owens, be signers on all checking accounts and that Trustee Wood, Mayor Pro Tem Stoumbaugh, Trustee Lavoie, and Town Clerk, Patti Owens, be signers on the safe deposit box. The motion carried.

Flying of Flags at Half-Staff

MAYOR PRO TEM STOUMBAUGH MOVED, TRUSTEE LAVOIE SECONDED to ask residents of the Town of Deer Trail to fly their flags at half-staff through Friday, August 5 at sunset, in honor of Mayor Rector. The motion carried.

The meeting will be continued on Tuesday, August 9 at 7:00 p.m.
