Special Meeting

August 27, 2004

 

CALL TO ORDER

The Board of Trustees of the Town of Deer Trail met in special session on Friday, August 27, 2004 at the Town Hall, 555 Second Avenue, Deer Trail, Colorado. The meeting was called to order by Mayor Tink Rector at 1:05 p.m.

The purpose of this meeting was to consider wastewater project easements, the street project, municipal law seminar, and municipal court.

ROLL CALL

Mayor: Tink Rector; Trustees Present: Ralph Haight, Gary Lavoie, Russell Ness, Tami Stoumbaugh, Dutch Venter, Melvin Wood

Staff Present: Patti Owens, Town Clerk; Stan Kimble, Town Attorney

WASTEWATER PROJECT EASEMENT

The Board discussed wastewater project easements on the Pelton and Boyd properties and reviewed options for acquisition of the easements.

TRUSTEE LAVOIE MOVED, TRUSTEE STOUMBAUGH SECONDED to proceed with condemnation of both Pelton and Boyd properties. Voting was as follows:  YES: Haight, Lavoie, Ness, Rector, Stoumbaugh, Venter, Wood  NO: None  ABSTAIN: None  ABSENT: None

The Mayor declared the motion carried.

Attorney Stan Kimble was advised not to begin proceedings until the first of next week.

STREET PROJECT

Mayor Rector asked the Board if they would consider paying for replacement of some curb and gutter along Date Street before paving.

TRUSTEE NESS MOVED, TRUSTEE LAVOIE SECONDED to replace the curb and gutter on the north side of Date St. from First Ave. to the post office driveway. Voting was as follows:  YES: Lavoie, Ness, Rector, Stoumbaugh, Venter, Wood, Haight  NO: None  ABSTAIN: None  ABSENT: None  The Mayor declared the motion carried.

MUNICIPAL LAW SEMINAR

Trustee Stoumbaugh told the Board she would not be able to attend the CML Municipal Law Seminar in September.

MUNICIPAL COURT

A lengthy discussion was held on the possibility of Deer Trail having a municipal court. Attorney Stan Kimble presented information about courts of record, law enforcement participation, code enforcement officer, ordinances, judges, complaints, liens, tax assessments, weeds and rubbish, dangerous buildings, inoperable vehicles, junkyards, and animal control.

Stan will contact Arapahoe County to see if they would be able to provide an officer on occasion when needed. If so, the Board will continue to pursue the option of a municipal court.

ADJOURNMENT

TRUSTEE LAVOIE MOVED, TRUSTEE WOOD SECONDED to adjourn the meeting. The special meeting was adjourned at 2:31 p.m.
