CALL TO ORDER

 

The Board of Trustees of the Town of Deer Trail met in regular session on Tuesday, August 4, 2009 at the Town Hall, 555 Second Avenue, Deer Trail, Colorado.  Mayor Frank Fields called the meeting to order at 7:00 p.m.

APPROVAL OF AGENDA

 

TRUSTEE JOHNSON MOVED, TRUSTEE MONNAHAN SECONDED to approve the agenda.  The motion carried.

 

APPROVAL OF THE MINUTES

 

TRUSTEE PISEL MOVED, MAYOR FIELDS SECONDED to approve the July 7, 2009 regular meeting minutes.  The motion carried.

 

PUBLIC COMMENTS

 

A letter from Sheryl Hahn regarding a trench in her alley was reviewed.  The trench in the alley between Third and Fourth Avenues near Date Street was dug by an adjacent property owner.  Sheryl asked that the trench be filled.  Board members will look at the trench and address the issue again at the September 1 regular Board meeting.

 

Mayor Fields spoke for Raymond Behrens of the Jockey Club who was unable to attend the meeting.  The Jockey Club is planning horse races at the Jockey Club Grounds and would like access to Ivy Street at the north end of their property.  They will possibly install gates at that location and install a culvert between their property and Ivy Street.  More information will be available at the September 1 regular Board meeting.

 

REPORTS

 

Water & Sewer

The Town’s wells pumped 2,287,000 gallons of water in July, 2009.

 

 

 

 

APPROVAL AND PAYMENT OF BILLS

 

Discussion was held on the bill submitted by Kiewit Western for crushed asphalt.  After review, it was determined the Town was billed incorrectly.  Kiewit Western will be contacted, the error will be corrected, and the bill will be paid.

 

MAYOR FIELDS MOVED, TRUSTEE JOHNSON SECONDED to approve the payment of the bills.  Voting was as follows:

                YES:                       Fields, Hardwick, Johnson, Mergl, Monnahan, Pisel, Venter

                NO:                         None

                ABSTAIN:            None

The Mayor declared the motion carried.

 

UNFINISHED BUSINESS

 

Vicious Dogs

The Board reviewed emails between Arapahoe County Animal Control, the Town, and Town Attorney Stan Kimble about the possibility of an Intergovernmental Agreement between the Town and Animal Control for enforcement of the Vicious Dog portion of the County’s Animal Control Ordinance.  Kimble is waiting for information from Arapahoe County Attorney Katherine Schroeder.  More discussion will be held at the September 1 regular Board meeting.

 

NEW BUSINESS

 

Temporary Construction Agreement

Arapahoe County Road & Bridge is doing maintenance work on an existing cross culvert at the intersection of County Roads 217 and 34.  Work consists of construction of a six-foot bottom drainage ditch, reseeding, and riprap placement.  The County is asking for an agreement with the Town for temporary access to Town property for six months to maintain the culvert with the option to extend the agreement in the future.

 

MAYOR FIELDS MOVED, TRUSTEE MONNAHAN SECONDED to approve the Temporary Construction Access agreement with Arapahoe County.  Voting was as follows:

Liquor License Renewal – Brown Derby

The Brown Derby submitted an application for renewal of its liquor license.  The state fee of $500 was paid; the Town’s fee of $75 was not paid.

 

TRUSTEE HARDWICK MOVED, TRUSTEE PISEL MOVED to approve the liquor license renewal application upon receipt of the Town’s fee of $75.  Voting was as follows:

                YES:                        Johnson, Mergl, Monnahan, Pisel, Venter, Fields, Hardwick

                NO:                         None

                ABSTAIN:            None

                ABSENT:               None

The Mayor declared the motion carried.

 

 

 

Special Events Permit – BPOE #2307

BPOE #2307 submitted an application for a Special Events Permit for August 14, 15, and 16.  All fees have been paid and the premises were posted properly.  The state’s Liquor Enforcement Division requires Special Events Permits applications be filed ten days before the event.  The state will receive the application on August 6 which is eight days prior to the event.

 

TRUSTEE MONNAHAN MOVED, MAYOR FIELDS SECONDED to approve the Special Events Permit application submitted by the Elks.  Voting was as follows:

                YES:                        Mergl, Monnahan, Pisel, Venter, Fields, Hardwick, Johnson

                NO:                         None

                ABSTAIN:            None

                ABSENT:               None

The Mayor declared the motion carried.

               

TRUSTEES’ COMMENTS

Trustee Johnson reported that government entities, i.e. state or county, are not selling road graders at a discounted price.

 

The Town Clerk reported that the Town has used almost all of its mosquito spray this summer, and has enough to spray three or four more times.

 

Trustee Monnahan asked Glenn Kunkel what he was going to do with the bull thistles on his East Bijou Estates property.  Kunkel said he would discuss it with Monnahan.

 

Trustee Monnahan asked if Mayor Fields had met with Kevan Northup from Spur Mountain Timber about marking off the Town’s one and one-half acres.  Mayor Fields responded that he had not.
