CALL TO ORDER

The Board of Trustees of the Town of Deer Trail met in special session on January 20, 2004 at the Town Hall, 555 Second Avenue, Deer Trail, Colorado. The meeting was called to order by Mayor Tink Rector at 7:00 p.m.

The purpose of this meeting was to discuss details for the proposed sales/use tax to be placed on the April, 2004 ballot.

ROLL CALL

Mayor: Tink Rector  Trustees Present: Ralph Haight, Gary Lavoie, Russell Ness, Dutch Venter, Melvin Wood  Staff Present: Patti Owens, Town Clerk  Public Present: Bob Sanger, Kent Vashus, Chris Garner, Belinda Deal

SALES TAX

At the December, 2003, the Board of Trustees voted to place a sales/use tax issue on the April, 2004 ballot.

TRUSTEE LAVOIE MOVED, TRUSTEE NESS SECONDED that the sales/use tax percentage be set at three percent. Voting was as follows:  YES: Haight, Lavoie, Rector  NO: Ness, Venter, Wood  ABSTAIN: None  ABSENT: Stoumbaugh  The Mayor declared the motion lost.

TRUSTEE NESS MOVED, TRUSTEE WOOD SECONDED that the sales/use tax percentage be set at two percent. Voting was as follows:  YES: Ness, Wood, Haight  NO: Rector, Venter, Lavoie  ABSTAIN: None  ABSENT: Stoumbaugh  The Mayor declared the motion lost.

TRUSTEE HAIGHT MOVED, TRUSTEE LAVOIE SECONDED that the sales/use tax percentage be set at two and one-half percent. Voting was as follows:  YES: Rector, Wood, Haight, Lavoie  NO: Ness, Venter  ABSTAIN: None  ABSENT: Stoumbaugh  The Mayor declared the motion carried.

TRUSTEE HAIGHT MOVED, TRUSTEE LAVOIE SECONDED that one and one-half percent of the two and one-half percent (60%) be earmarked for streets and drainage, with the remaining money going to the general fund. Voting was as follows:  YES: Rector, Wood, Haight, Lavoie  NO: Ness, Venter  ABSTAIN: None  ABSENT: Stoumbaugh  The Mayor declared the motion carried.

TRUSTEE LAVOIE MOVED, TRUSTEE HAIGHT SECONDED that food for home consumption and occasional sales by charitable organizations be exempt from sales tax. Voting was as follows:  YES: Wood, Haight, Lavoie, Ness, Rector  NO: Venter  ABSTAIN: None  ABSENT: Stoumbaugh  The Mayor declared the motion carried.

TRUSTEE LAVOIE MOVED, TRUSTEE WOOD SECONDED that no vendor fee be allowed. Voting was as follows:  YES: Haight, Lavoie, Ness, Rector, Wood  NO: Venter  ABSTAIN: None  ABSENT: Stoumbaugh  The Mayor declared the motion carried.

TRUSTEE LAVOIE MOVED, TRUSTEE HAIGHT SECONDED that no refunds be issued. Voting was as follows:  YES: Haight, Lavoie, Ness, Rector, Wood  NO: Venter  ABSTAIN: None  ABSENT: Stoumbaugh  The Mayor declared the motion carried.

ADJOURNMENT

MAYOR RECTOR MOVED, TRUSTEE HAIGHT SECONDED to adjourn the meeting. The motion carried. The regular meeting was adjourned at 7:58 p.m.
