CALL TO ORDER

The Board of Trustees of the Town of Deer Trail met in regular session on September 2, 2003 at the Town Hall, 555 Second Avenue, Deer Trail, Colorado. The meeting was called to order by Mayor Tink Rector at 7:05 p.m.

ROLL CALL

Mayor: Tink Rector. Trustees Present:  Gary Lavoie, Russell Ness, Tami Stoumbaugh, Dutch Venter, Melvin Wood. Staff Present: Patti Owens, Town Clerk. Public Present: Robyn Lydick, Bertha Rector, Bob Sanger, Anne Culver, Mike Donohue

APPROVAL OF AGENDA

TRUSTEE WOOD MOVED, TRUSTEE LAVOIE SECONDED to approve the agenda. The motion carried.

PUBLIC HEARING

Ordinance 213 - Adopting Codes by Reference

Mayor Rector opened the Public Hearing for Ordinance 213 at 7:10 p.m. Ordinance 213 adopts the Uniform Building Code, the Uniform Fire Code, the Uniform Mechanical Code, the Uniform Plumbing Code, and the National Electrical Code by reference

Town Clerk Patti Owens verified that notice of the public hearing had been published and posted.

There were no public comments.

Mayor Rector closed the public hearing at 7:17 p.m.

TRUSTEE LAVOIE MOVED, TRUSTEE STOUMBAUGH SECONDED to adopt Ordinance 213. Voting was as follows:

YES: Lavoie, Ness, Rector, Stoumbaugh, Venter, Wood

NO: None

ABSENT: Haight

The Mayor declared the motion carried.

APPROVAL OF THE MINUTES

TRUSTEE NESS MOVED, TRUSTEE LAVOIE SECONDED to approve the August 5, 2003 regular meeting minutes. The motion carried.

PUBLIC PARTICIPATION

No one in attendance had comments.

REPORTS

Water & Sewer

Readings

The Town Clerk reported water usage for the month of August, 2003 was 3,780,000. The sewer flow meter was calibrated in August. Average sewer flow for August was 33,351 gallons per day.

Water & Sewer

Painting Bid

Bids from three companies for painting and repairing the elevated water storage tank were reviewed.

Trustee Haight arrived at 7:15 p.m.

TRUSTEE LAVOIE MOVED, TRUSTEE STOUMBAUGH SECONDED to accept the bid from Utility Service Company for $15,500 to paint the elevated water storage tank as well as their bid of $2,350 to install a new roof hatch to prevent run-off and contaminants from entering the tank. Voting was as follows:

YES: Ness, Rector, Stoumbaugh, Venter, Wood, Haight, Lavoie

NO: None

ABSENT: None

The Mayor declared the motion carried.

Water & Sewer

Insurance Claim

The Town Clerk reported on an insurance claim filed with CIRSA for a sewer main back-up on August 14, 2003. The Town will be responsible for $500 for the deductible.

Water & Sewer

Wastewater Exam

Maintenance Man Randy Eldringhoff passed his Small System Wastewater Exam and is asking the Town to pay a $60 administration fee required by the Certification Board.

TRUSTEE NESS MOVED, TRUSTEE WOOD SECONDED to approve payment of the $60 administration fee for Randy Eldringhoff's small system wastewater certificate. Voting was as follows:

YES: Rector, Stoumbaugh, Venter, Wood, Haight, Lavoie, Ness

NO: None

The Mayor declared the motion carried.

Financial

The Town Clerk presented July 31, 2003 budget reports.

Safety Committee

The safety committee had no report. A request was made for a stop sign at the intersection of Fourth Ave. and Date St.

CDBG Grant

The Town has been reimbursed for the swing set. The Board was presented with a list of eligible activities for the 2004 CDBG grant.

GMS, Inc. Sewer Project

An engineering agreement with GMS, Inc. for the sewer project was submitted to the Board.

TRUSTEE STOUMBAUGH MOVED, TRUSTEE LAVOIE SECONDED to approve the Agreement for Engineering Services between the Town of Deer Trail and GMS, Inc. Voting was as follows:

YES: Stoumbaugh, Venter, Wood, Haight, Lavoie, Ness, and Rector

NO: None

ABSENT: None

The Mayor declared the motion carried.

GMS, Inc. will present the Utility Plan to DRCOG on September 3.

APPROVAL AND PAYMENT OF BILLS

Mike Donohue from Western Chip Seal was on hand to discuss his bill for asphalt on Date St. between First and Second Avenues. Mayor Rector pointed out several items that had not been done per their verbal agreement.

TRUSTEE LAVOIE MOVED, TRUSTEE WOOD SECONDED to pay Western Chip Seal $6,830 for 6,210 square feet of asphalt installed on August 28, 2003. Voting was as follows:

YES: Venter, Wood, Haight, Lavoie, Ness, Rector, Stoumbaugh

NO: None

ABSTAIN: None

The Mayor declared the motion carried.

TRUSTEE STOUMBAUGH MOVED, TRUSTEE LAVOIE SECONDED to approve the payment of the bills. Voting was as follows:

YES: Wood, Lavoie, Ness, Rector, Stoumbaugh, Venter

NO: None

ABSTAIN: Haight

ABSENT: None

UNFINISHED BUSINESS

Water & Sewer Permits

Bill & Ilene Allison

The Board reviewed drawings presented by Bill and Ilene Allison.

TRUSTEE LAVOIE MOVED, TRUSTEE STOUMBAUGH SECONDED to delay approval of water and sewer permits until all paperwork has been submitted for review by GMS, Inc. The motion carried.

TRUSTEE HAIGHT MOVED, TRUSTEE LAVOIE SECONDED to pay for GMS. Inc's. first review of the Allison's information and all subsequent reviews are paid for by the Allisons. Voting was as follows:

YES: Haight, Lavoie, Ness, Rector, Stoumbaugh, Venter, Wood

NO: None

ABSTAIN: None

Seventh Avenue Fire Hydrant

Trustee Ness requested an update on the previously approved fire hydrant on Seventh Avenue. Interstate Irrigation will be asked to submit a bid on the project.

Trustee Ness also asked to have the ditch on Seventh Avenue cleaned in which a fire hydrant is located and to have a riser put on the hydrant.

NEW BUSINESS

Clean-Up Day

TRUSTEE LAVOIE MOVED, TRUSTEE STOUMBAUGH SECONDED to schedule a Town Clean-Up Day on Saturday, September 20 from 9 a.m. - 1 p.m. The motion carried.

Swim's Disposal will be contacted to bring a trash truck. Clean-Up Day will be for Deer Trail residents only and be limited for one pickup load per family. No tree branches will be allowed.

Elks' Special Events Permit

TRUSTEE STOUMBAUGH MOVED, TRUSTEE LAVOIE SECONDED to approve the Elks' special events permit for November 1 and November 2, 2003. Voting was as follows:

YES: Lavoie, Ness, Rector, Stoumbaugh, Venter, Haight

NO: None

ABSTAIN: Wood

ABSENT: None

The Mayor declared the motion carried.

CORRESPONDENCE

A citizen's complaint form regarding dogs running-at-large was addressed by the Board. Citizens will be asked to refrain from allowing their dogs to run at-large in the Town's newsletter.

Trustee Ness expressed concern about a stop sign being blocked from view by a trailer and trees at the corner of Fifth Avenue and Aspen Street. Another stop sign is blocked at the corner of Second Avenue and Elm Street.

Trustee Ness asked if the water line replacement project on Cedar Street between First and Second Avenues had been scheduled. The project has been postponed until further notice.

Trustee Lavoie reported the elevated water storage tank had run over numerous times in the summer. Bids are being received for gauge replacement.

MAYOR RECTOR MOVED, TRUSTEE LAVOIE SECONDED to adjourn the meeting. The motion carried. The regular meeting was adjourned at 8:10 p.m.
