TOWN OF DEER TRAIL, COLORADO BOARD OF TRUSTEES April 8, 2008
Mayor Jim Johnson, Mayor Pro Tem Tami Stoumbaugh, and Trustee Melvin Wood were not in attendance. In order to have a quorum, newly elected Trustees David Boyd, Frank Fields, and Robert Hardwick were sworn in. Trustee Harry Venter was named meeting Chairman.
Public Hearing
The matter at hand was the annexations of Spur Mountain Timber and Turecek West. All parties agreed to include both annexations in the same procedure.
Chairman Venter opened the public hearing at 7:00 p.m.
The Town Clerk presented the following documents: (2) ownership documents; (2) Pre-Annexation Agreements; (2) Petitions for Annexation accompanied by affidavits of circulators; (4) copies of each annexation map, dated March 12, 2008, prepared by Cottonwood Surveying and Associates, Inc., a Colorado Registered Professional Land Surveyor, showing the boundaries as well as providing written legal description of the boundaries, location of each ownership tract in the unplatted land, and drawing of contiguous boundary of the Town of Deer Trail; Quit Claim Deed transferring Spur Mountain Timber’s water rights to the Town (Turecek West will transfer rights upon a transaction between Spur Mountain Timber and Turecek West); Resolution 08-03, dated March 4, 2008 finding substantial compliance for the Spur Mountain Timber Annexation; Resolution 08-04, dated March 11, 2008, finding substantial compliance for the Turecek West Annexation; Spur Mountain Timber Annexation Agreement; Turecek West Annexation Agreement; (2) letters from the Town granting waiver of Annexation Impact Reports and requesting the same from Arapahoe County; letter of permission, dated April 7, 2008, allowing Spur Mountain Timber to construct a water well; letter of permission, dated April 7, 2008, allowing Spur Mountain Timber to install a septic system; (2) tax certificates; Affidavit of Proof of Publication from Tri-County Tribune for four weeks of publication of the notice of the public hearing and text of Resolution 08-03 and Resolution 08-04; and list of taxing entities notified of the public hearing. Total expenses for the annexations have not yet been determined.
Chairman Venter asked for public comments.
Kenny Ross asked if the annexed properties will be zoned agricultural or commercial. Venter responded that the Town has no zoning.
Chairman Venter closed the public hearing at 7:10 p.m.

The Board of Trustees of the Town of Deer Trail met in regular session on Tuesday, April 8, 2008 at the Town Hall, 555 Second Avenue, Deer Trail, Colorado. Chairman Harry Venter called the meeting to order at 7:10 p.m.

Spur Mountain Timber Annexation Turecek West Annexation
TRUSTEE FIELDS MOVED, TRUSTEE BOYD SECONDED to approve Resolution 08-06 concerning a petition for the annexation of property to the Town of Deer Trail, Colorado, known as Spur Mountain Timber Annexation to the Town of Deer Trail, and finding the area proposed to be annexed eligible for annexation. Voting was as follows: YES: Hardwick, Venter, Boyd, Fields NO: None ABSTAIN: None ABSENT: Johnson, Stoumbaugh, Wood The Chairman declared the motion carried.

NEW BUSINESS
New Trustees The Board will make department appointments and appoint check signers at their next regular meeting.
Recall Election Per C.R.S. 31-4-503(4), the Town Clerk announced that the petitions to recall Mayor James Johnson were sufficient. She presented them to the Board of Trustees, along with the Certificate of Sufficiency.
Before the Board set a date for the recall election, the Town Clerk read a letter of resignation from Mayor Johnson. No recall election will be held.
Pardon Judicial Actions
