CALL TO ORDER
The Board of Trustees of the Town of Deer Trail met in regular session on Tuesday, February 2, 2010 at the Town Hall, 555 Second Avenue, Deer Trail, Colorado. Mayor Frank Fields called the meeting to order at 7:00 p.m.

APPROVAL OF AGENDA
TRUSTEE HARDWICK MOVED, MAYOR FIELDS SECONDED to approve the agenda with the addition of Deer Trail High School Student Council to New Business. The motion carried.
APPROVAL OF THE MINUTES
TRUSTEE HARDWICK MOVED, TRUSTEE MONNAHAN MAYOR SECONDED to approve the January 5, 2010 regular meeting minutes. The motion carried.
PUBLIC COMMENTS
Tim Sell presented an invoice from Woodland Farm and Feed and asked it be read aloud. The invoice was read by the Town Clerk.
REPORTS
Water & Sewer The Town’s wells pumped 1,155,200 gallons of water in January, 2010.
APPROVAL AND PAYMENT OF BILLS
TRUSTEE HARDWICK MOVED, MAYOR FIELDS SECONDED to approve the payment of the bills. Voting was as follows: YES: Fields, Hardwick, Mergl, Monnahan, Pisel, Venter NO: None ABSTAIN: None ABSENT: Johnson The Mayor declared the motion carried.
UNFINISHED BUSINESS
CDBG Grant Projects The Town Clerk updated the Board on the American Recovery and Reinvestment Act paving grant. The Town will be receiving an agreement for signature and a Notice to Proceed.
NEW BUSINESS
2010 Municipal Election The four-year Mayor position, three four-year trustee positions, and two two-year trustee positions will be filled at the Tuesday, April 6, 2010 regular election. Nomination petitions will be available on Monday, February 15.
TRUSTEE PISEL MOVED, TRUSTEE HARDWICK SECONDED to adopt Resolution 10-03 authorizing the Town Clerk to appoint election judges at a rate of pay of $100/judge/day. Voting was as follows: YES: Hardwick, Mergl, Monnahan, Pisel, Venter, Fields NO: None ABSTAIN: None ABSENT: Johnson The Mayor declared the motion carried.
Emergency Ordinance
MAYOR FIELDS MOVED, TRUSTEE MONNAHAN SECONDED to approve emergency Ordinance No. 246 imposing a temporary moratorium on the use of any property located in the Town of Deer Trail, Arapahoe County, Colorado, pertaining to the sale and distribution of medical marijuana, and upon the submission, acceptance, processing or approval of any application for a license or permit related to the operation of a business that sells or distributes medical marijuana pursuant to the authority granted by Article XVIII, Section 14 of the Colorado constitution; directing the prompt investigation of the Town’s regulatory authority over such businesses; declaring the intention of the Board of Trustees to consider the adoption of appropriate regulations with respect to such businesses if permitted by law. Voting was as follows: YES: Mergl, Monnahan, Pisel, Venter, Fields, Hardwick NO: None ABSTAIN: None ABSENT: Johnson The Mayor declared the motion carried.
2010 Arapahoe County Sheriff’s Agreement The Board reviewed the 2010 Arapahoe County Sheriff’s Agreement which is based on a mil of 4.982 on property valuation, $15,308.64, plus an additional fee of $1,200.00 for dispatch services.
TRUSTEE HARDWICK MOVED, TRUSTEE MONNAHAN SECONDED to approve the 2010 Agreement for Law Enforcement Services with Arapahoe County at a cost of $16,508.64. Voting was as follows: YES: Monnahan, Pisel, Venter, Fields, Hardwick, Mergl NO: None ABSTAIN: None ABSENT: Johnson The Mayor declared the motion carried.
Deer Trail High School Student Council Donation The Deer Trail High School Student Council provided 105 sacks of candy for children after the school’s Winter Concert in December.
TRUSTEE HARDWICK MOVED, MAYOR FIELDS SECONDED to donate $100 to the Deer Trail High School Student Council to help defray the cost of the candy sacks distributed after the school’s Winter Concert in December. Voting was as follows: YES: Pisel, Venter, Fields, Hardwick, Mergl, Monnahan NO: None ABSTAIN: None ABSENT: Johnson The Mayor declared the motion carried.
TRUSTEES’ COMMENTS
Trustee Pisel asked if the annual pet vaccination clinic had been scheduled.
Town Clean-Up Day was discussed.
Mayor Fields told the Board that two loads of crushed asphalt will be ordered.
Trustee Monnahan asked what the Board was going to do about Woodland Farm and Feed.
ADJOURNMENT
MAYOR FIELDS adjourned the regular meeting at 7:39 p.m.
