TOWN OF DEER TRAIL, COLORADO BOARD OF TRUSTEES Regular Meeting June 6, 2006
CALL TO ORDER The Board of Trustees of the Town of Deer Trail met in regular session on Tuesday, June 6, 2006 at the Town Hall, 555 Second Avenue, Deer Trail, Colorado. Mayor Jim Johnson called the meeting to order at 7:00 p.m. ROLL CALL Mayor Jim Johnson Trustees Present: Gary Lavoie, Russell Ness, Bob Sanger, Tami Stoumbaugh, Dutch Venter Staff Present: Patti Owens, Town Clerk; Rick Wright, Maintenance APPROVAL OF AGENDA TRUSTEE STOUMBAUGH MOVED, MAYOR JOHNSON SECONDED to approve the agenda. The motion carried. APPROVAL OF THE MINUTES TRUSTEE NESS MOVED, TRUSTEE STOUMBAUGH SECONDED to approve the May 2, 2006 regular meeting minutes. The motion carried. PUBLIC COMMENTS Mitch Costanza and Donna Hull from Metro Wastewater Reclamation District gave information to the Board about the company’s procedures, treatment plant, and farm land east of Town. The company wishes to maintain ongoing communication with the Board of Trustees. They distributed information packets and DVDs. Rick Wright reported that the Grace Baptist Church would like to house a Youth Outreach Center in the A-frame on the church’s property on Seventh Avenue. On June 13, the church will host Stranger Danger; on June 17, a free concert at the church, and on August 26 a Safety Fest. REPORTS Water & Sewer -Readings A written report by water/wastewater operator Erik Tameler was reviewed by the Board. The town used 2,759,000 gallons of water in May. Town Clerk's Report The Town received $177 from Arapahoe County for delinquent water and sewer accounts that were assessed to property taxes. The town has not yet received the Notice to Proceed from Arapahoe County for the asphalt paving and curb and gutter projects. The Town Clerk presented the Town’s application for the Justice Assistance Grant for code enforcement at the Jefferson County District Attorney’s office on June 1. Word has not yet been received on an award. APPROVAL AND PAYMENT OF BILLS TRUSTEE STOUMBAUGH MOVED, TRUSTEE LAVOIE SECONDED to approve the payment of the bills. UNFINISHED BUSINESS Fireworks MAYOR JOHNSON MOVED, TRUSTEE STOUMBAUGH SECONDED to approve purchase of fireworks with the total amount of donations plus the Town’s contribution to equal $3,000. Voting was as follows: YES: Ness, Sanger, Stoumbaugh, Johnson NO: Lavoie, Venter ABSTAIN: None ABSENT: Wood The Mayor declared the motion carried. Dangerous Building Demolition One bid was submitted for demolition of the building at 692 First Ave. TRUSTEE LAVIOE MOVED, TRUSTEE STOUMBAUGH SECONDED to approve the bid in the amount of $9,050 submitted by Kunkel Construction, Inc., for the demolition and removal of the building at 692 First Ave. Voting was as follows: YES: Ness, Sanger, Stoumbaugh, Venter, Johnson, Lavoie NO: None ABSTAIN: None ABSENT: Wood The Mayor declared the motion carried. The Town Clerk will prepare a contract for review by CIRSA. Dorothy Doherty’s correspondence with the Board concerning a building she owns which is adjacent to the building scheduled for demolition was addressed. The Board will ask her for access to the inside of her building for inspection purposes. Ordinance No. 233 – Nuisance Ordinance TRUSTEE STOUMBAUGH MOVED, TRUSTEE LAVOIE SECONDED to approve Ordinance No. 233 relating to the definition and abatement of nuisances within the corporate limits of the town of Deer Trail, repealing all ordinances in conflict therewith, and providing for violation thereof. TRUSTEE STOUMBAUGH withdrew her motion. TRUSTEE STOUMBAUGH MOVED, TRUSTEE LAVOIE SECONDED to add a “Weeds” section to Ordinance No. 233. Voting was as follows: YES: Sanger, Stoumbaugh, Venter, Johnson, Lavoie, Ness NO: None ABSTAIN: None ABSENT: Wood The Mayor declared the motion carried. TRUSTEE STOUMBAUGH MOVED, TRUSTEE LAVOIE SECONDED to approve Ordinance No. 233 relating to the definition and abatement of nuisances within the corporate limits of the town of Deer Trail, repealing all ordinances in conflict therewith, and providing for violation thereof. Ordinance 234 – Amendment of Ordinance 227 (Revenue Bond) TRUSTEE STOUMBAUGH MOVED, TRUSTEE LAVOIE SECONDED to approve emergency Ordinance No. 234 amending Ordinance No. 227, relating to the issuance of the Town’s sanitary sewer revenue bonds in the aggregate principal amount of $717,000 and providing certain details with regard thereto, and declaring an emergency. Voting was as follows: YES: Venter, Johnson, Lavoie, Ness, Sanger, Stoumbaugh NO: None ABSTAIN: None ABSENT: Wood The Mayor declared the motion carried. Resolution 2006-01S – Amendment of Resolution 2005-01S (Revenue Bond) TRUSTEE STOUMBAUGH MOVED, TRUSTEE NESS SECONDED to approve Resolution No. 2006-01S amending certain provisions of Resolution No. 2005-01S which authorized the issuance of the Town’s sanitary sewer revenue bonds in the aggregate principal amount of $717,000. Voting was as follows: YES: Johnson, Lavoie, Ness, Sanger, Stoumbaugh, Venter NO: None ABSTAIN: None ABSENT: Wood The Mayor declared the motion carried. NEW BUSINESS Second Ave. and Burton St. Drainage Mayor Johnson presented plans for a drain pan at Second Ave. and Burton St. MAYOR JOHNSON MOVED, TRUSTEE LAVOIE SECONDED to advertise for bids for the drain pan at Second Ave. and Burton St. with bids due at the Town Hall on Wednesday, July 5. Summer Youth Baseball Donation TRUSTEE LAVOIE MOVED, MAYOR JOHNSON SECONDED to donate $300 to Deer Trail’s summer youth baseball program. Backhoe Purchase Several options for purchase of a backhoe were reviewed. No action was taken. Liquor License Renewal – Phillips 66 TRUSTEE LAVOIE MOVED, TRUSTEE STOUMBAUGH SECONDED to renew the liquor license for Deer Trail 66. Meeting Date Change TRUSTEE LAVOIE MOVED, TRUSTEE NESS SECONDED to change the July regular meeting from July 4 to July 5. Voting was as follows: YES: Lavoie, Ness, Sanger, Stoumbaugh, Johnson NO: Venter ABSTAIN: None ABSENT: Wood The Mayor declared the motion carried. TRUSTEES' COMMENTS Trustee Ness thanked Trustee Lavoie for his help with Clean-Up Day. The Town filled three roll-off dumpsters. He also thanked Trustees Sanger and Wood for monitoring the tree limb disposal at the wastewater treatment plant. Trustee Ness would like water meter pit lids painted so they can be located more easily. Trustee Ness reported that a request had been made to trim the weeds around the lift station at First Ave. and Ivy St. Mayor Johnson also thanked everyone for their help on Town Clean-Up Day.
