CALL TO ORDER

The Board of Trustees of the Town of Deer Trail met in regular session on Tuesday, October 5, 2010 at the Town Hall, 555 Second Avenue, Deer Trail, Colorado.  Mayor Frank Fields called the meeting to order at 7:00 p.m.

APPROVAL OF AGENDA

TRUSTEE HARDWICK MOVED, TRUSTEE JEFFREY SECONDED to approve the agenda.  The motion carried.

APPROVAL OF THE MINUTES

TRUSTEE HARDWICK MOVED, TRUSTEE BEHRENS SECONDED to approve the September 7, 2010 regular meeting minutes.  The motion carried.

PUBLIC COMMENTS

Phillip Steel suggested the Board consider allowing medical marijuana as a way to generate revenue.

REPORTS

Water & Sewer

The Town’s wells pumped 2,661,000 gallons of water in September, 2010.

APPROVAL AND PAYMENT OF BILLS

TRUSTEE MONNANAH MOVED, MAYOR FIELDS SECONDED to approve the payment of the bills.  Voting was as follows:

                YES:                       Behrens, Fields, Hardwick, Jeffrey, Mergl, Monnahan, Pisel

                NO:                         None

                ABSTAIN:            None

                ABSENT:               None

The Mayor declared the motion carried.

NEW BUSINESS

2011 CDBG Application

TRUSTEE MERGL MOVED, TRUSTEE MONNAHAN SECONDED to apply for the $10,000 guaranteed set-aside CDBG funds for 2011.  Voting was as follows:

                YES:                        Fields, Hardwick, Jeffrey, Mergl, Monnahan, Pisel, Behrens

                NO:                         None

                ABSTAIN:            None

                ABSENT:               None

The Mayor declared the motion carried.

Ordinance No. 248 – Prohibit Medical Marijuana

TRUSTEE HARDWICK MOVED, TRUSTEE BEHRENS SECONDED to approve the Ordinance No. 248 to prohibit certain uses relating to medical marijuana including the commercial retail sale, distribution, cultivation, and dispensing of medical marijuana and medical marijuana infused products within the Town of Deer Trail.  Voting was as follows:

                YES:                        Hardwick, Jeffrey, Mergl, Monnahan, Pisel, Behrens, Fields

                NO:                         None

                ABSTAIN:            None

                ABSENT:               None

The Mayor declared the motion carried.

2011 Preliminary Budgets

The Town Clerk presented the Board with 2011 preliminary budgets for General Fund, Water Fund, Sewer Fund, Open Space Fund, and Conservation Trust Fund.

Town Clean-Up Day

MAYOR FIELDS MOVED, TRUSTEE PISEL SECONDED to host a Town Clean-Up Day on Saturday, October 16, from 8 a.m. – noon with three roll-off dumpsters from Swim’s Disposal.  Voting was as follows:

                YES:                        Jeffrey, Mergl, Monnahan, Pisel, Behrens, Fields, Hardwick

                NO:                         None

                ABSTAIN:            None

                ABSENT:               None

The Mayor declared the motion carried.

No comments were offered.

ADJOURNMENT

MAYOR FIELDS adjourned the regular meeting at 7:30 p.m.
